we want to find out what happened and prevent anything like this from happening again if possible. >> the investigation into what led an oil tanker to hit the base of the bay bridge continues. good afternoon. i'm tori campbell. this morning, the pilot's whose tanker struck -- who struck the bay bridge is interviewed by

the coast guard. cal has more >> reporter: the ship is still out here in the san francisco bay. the 750-tanker hit one of the support towers of the bay bridge yesterday around 11:00 in foggy conditions. authorities say no oil was leak. the ship had just unloaded at a martinez refinery. the coast guard officials told us this morning a little bit more about its investigation. >> we're gonna continue to interview important members of the crew which includes the pilot and we'll also continue to interview members -- coast guard members who responded to the scene and find out what -- try to get more clues as to what happened. >> reporter: ktvu has learned the pilot passed an alcohol test yesterday. that pilot, george kleess, has eight years of experience but has had some problems in the past. now according to state records, kleess ran aground brieffully a sacramento river on august 27th

of 2009. then two days later, he ran into some wooden pylons on a catwalk in stockton. caltrans officials say the bridge itself sustained no structural damage as the wood in the metal fenders absorbed the impact just as they were supposed to. but the questions remain about how this happened and -- and if the pilot will be found at fault. we're told the ntsb will be doing two separate but concurrent investigations. we expect to learn more about that later today. live on treasure island, sal castanedo, ktvu channel 2 news. four men are accused of robbing a gas station and assaulting the clerk at the shell station on lone treeway. police say four men in their 20s rush the store and tried to steal cases of beer. the clerk said the men attacked

him when he tried to stop them. a man we spoke to is not surprised by the robbery. >> there is just -- a lot of negative activity around this area just as of late around the holidays. >> this morning, the clerk told us he was shaken up but is otherwise doing okay. police say the men only took beer, no cash or anything else was stolen. a man accused of setting his girlfriend on fire in san francisco is now facing attempted murder and arson charges. 22-year-old dexter oliver was arrested at an oakland motel around 9:00 last night. police say he doused his 25- year-old girlfriend with gasoline and lit her on fire sunday afternoon after the couple got into an argument outside of a laundromat. the victim is in the hospital with severe burns all the off -- all over her body. san francisco's newest supervisor has just been sworn in. >> i london breed do solemnly

swim and affirm. >> california attorney general cam ma laws harris on -- kamala harris on the street administered the oath to london breed. she represents the western edition and fillmore neighborhoods where she grew up in public housing. she defeated olag and five other candidates. a 19-year-old man pleaded not guilty to murder charges this morning in a san francisco court in connection with a deadly crash on new year's day. david morales is accused of shooting at three people and then leading police on a chase which ended when morales crashed his car at 21st street and south van ness avenue. two people were killed in the crash and one person suffered serious injuries. after this morning's hearing, morales' attorney called the crash a tragic accident. >> my condolences to the family. this is a tragedy for two people who died and the one seriously hurt. >> police say he's a known gang member but have not disclosed

his criminal record. the judge has set his bail at $10 million. the bicyclist accused of causing the death of a 71-year- old man in the castro district was back in court in morning. 36-year-old chris butare pleaded not guilty. prosecutors say he ran a red light at market and castro and hit the man in the crosswalk. he's pleaded not guilty to the charges. the need for prison reform in california is now over, at least that's what governor brown is saying today. ktvu's tara moriarty is live from san quentin to explain what is behind the governor's claim. good afternoon. >> reporter: good afternoon, the governor is challenging a federal court order that california further reduce its inmate populations in state prisons like san quentin by the june deadline. he held a press conference in sacramento. he spoke to reporters saying a team of experts evaluated the

healthcare system in state prisons. not only did they come out on top in the united states but in the world. he says california has provided more beds and built or ren nateed -- renovated healthcare facilities. court documents say the prison conditions have vastly improved making the judge's ruling no longer necessary. >> i'm hopeful we'll prevail in the 9th circuit. if not, we have a direct appeal to the scattered showers and we'll -- to the supreme court and we'll go there if needed. >> reporter: he slammed 25 federal reports which he says nit-picked california's perfectly fine prison system. he believes the reports were a waste of money. now, brown wants to get out from under the court order that requires california to spend more than $440 million a year sending inmates to prison in other states. the population in the state's 33 prisons has been reduced by more than 27,000 inmates since

2011. and he says this could force the state to release dangerous inmates. he wants the cap to 2009. now, that decision was upheld by the u.s. supreme court in 2011. so far the federal judges have said they will not consider raising the cap. live in san quentin, tara moriarty, ktvu channel 2 news. also, during this morning's news conference, governor brown said he completed his treatment for prostate cancer. he said his prognosis is good. >> i'm ready. i'm rarin' to go. don't expect me to leave too soon. [laughter] >> the governor announced last month he was undergoing radiation treatment for localized prostate cancer. he underwent treatment during the holidays. today marks the second anniversary of the shooting in tucson, arizona that injured former congresswoman, gabrielle giffords, and took the lives of six people.

gabrielle giffords and her husband marked the occasion by announcing a new effort to curb gun violence. the couple said they will work to raise money to fight the gun lobbyists in washington. kelly said he an gabrielle giffords plan to become prominent voices in support of gun control. relatives of victims in the colorado theater shooting jammed a croom for a second day of dramatic testimony. prosecutors are trying to convince a judge to put james holmes on trial for the killing of 12 people. today, they played two 911 calls from inside the movie theater with the unmistakable backdrop of gunfire. defense attorneys are expected to argue that holmes has diminished mental capacity. the preliminary hearing will likely last all week. a public memorial has been set for a teen who turned up dead in lake tahoe last week. the services are planned for alyssa byrne in petaluma at her

high school. she was attending a music festival with friends. investigators say she tried walking back to her hotel from the concert. after three days of searching, a utility found her body in a snowbank along the side of the road. results from an autopsy are expected in a few weeks. raging wildfires blistering temperatures and high winds are creating catastrophic conditions in australia today. firefighters are battling scores of wildfires across the southeast as temperatures soar as high as 113 degrees in some areas. tens of thousands of acres have burned and dozens of homes have been destroyed. no deaths have been reported but search teams are trying to account for 100 missing residents from one burned down. >> reporter: we're live in san jose where you may soon see fewer parking spaces downtown but some business owners say it's worth it. we'll tell you what proposal is being voted on today. another beautiful day

that injured an innocent taco struck worker. the shooting happened around 8:30 on 23rd avenue near foothill boulevard. dash boulevard. police say the intended -- foothill boulevard. police say the intended victim tried to run away but crashed. a $5,000 reward is being offered in the search for those suspects. earlier today, a teenager became oakland's first homicide victim of the year. police say he was shot as he sat alone in a car parked near heggenberger road and hamilton street. the system alerted police to the shooting just before 1:00 in the afternoon. no word on a suspect or a motive. a former oakland nursing student accused of killing seven people has been declared not mentally competent to stand trial. an alameda county judge issued the ruling after reviewing reports from two psychiatrists

who examined goe. they concluded he suffers from paranoid schizophrenia. he's accused of killing six and injuries others. he could stand trial in the future, though, if doctors determine his condition has changed. walnut creek police have released more information about what led to the city's first officer-involved shooting in 12 years. 22-year-old anthony banta was killed in miss home on december 27th. police say it started as a 911 call from his roommate claiming he was being attacked. when officers arrived, they say banta ran at him holding a 10- inch kitchen knife. investigators say the officers fired shots. when banta ignored their "to drop the knife, they -- their

requests to drop the knife, they fired. the search continues for a man who vanished from scotts valley. they say alex fossgreen left home and has not been heard from since. they are searching the area where he's known to hike. an aerial search will focus on empire and quarry road where there was a possible sighting of him on saturday. a proposal that would add a little european flair to the south bay is being considered. it involves setting out more outdoor dining. ktvu's janine de la vega joins us from san jose to explain the response. >> reporter: this is one of three restaurants in the area that has expanded its sidewalks and added outdoor seating. i'm the only one out here because it's a little bit chilly out here. but one city council man says there is should be more areas like this. this afternoon, the city council will vote whether to

begin a pilot program that would allow residents to replace parking spots adjacent to their business with more sidewalk place for their benches, tables, planters and artwork. under the program, five businesses would be allowed to expand the sidewalk. the program will attract more to use downtown making it more vibrant. >> we recognize that by allowing curb cafes to exist, we'll be narrowing streets and eliminating parking in some spaces. but restaurant owners believe it's worth the sacrifice. >> reporter: the renovations made for the three existing cafes were paid for by the city several yearsback but under this pilot program, the business would be responsible for paying for the work needed to transform the parking spaces into the calffy. calf day for scottie is one of the restaurants that has outdoor seating. and if the others did, people believe it would increase foot traffic.
